1. Acceptance of Terms
By using our website or engaging with our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please discontinue use.
2. Services Provided
Colorado Web Impressions offers professional digital marketing services including but not limited to:
Website design and development
SEO (Search Engine Optimization)
Social media marketing and management
Paid advertising campaign management
Brand and online reputation services
We reserve the right to modify or discontinue services at any time without notice.
3. Client Responsibilities
Clients agree to:
Provide accurate, complete, and timely information
Respond to communications and approve deliverables in a timely manner
Fulfill agreed payment terms
Supply necessary content (logos, text, credentials) by deadlines
4. Payment Terms
Unless otherwise stated in writing:
Payment is due upon receipt of invoice
A deposit may be required to begin work
Late payments may result in work delays or suspension
All deposits are non-refundable
Ownership of deliverables transfers only after full payment
5. Revisions & Scope Changes
Projects include a set number of revisions as defined in the agreement. Additional revisions or scope changes outside the original agreement may be billed separately. All revisions must be approved in writing.
6. Turnaround Times & Client Delays
Timelines are dependent on client responsiveness. Delays in approvals, feedback, or content delivery may result in project rescheduling or additional charges. We are not responsible for delays caused by the client.
7. Subcontractors & Tools
We reserve the right to use subcontractors, freelance professionals, or third-party software/services to fulfill work. All third-party partners are held to our quality and confidentiality standards.
8. Intellectual Property
All work produced remains the property of Colorado Web Impressions until final payment is received. After payment, ownership of approved final work transfers to the client. We retain the right to display completed projects in our portfolio unless otherwise requested in writing.
9. No Guarantee
We do not guarantee specific results such as search engine rankings, traffic increases, or ROI. Marketing outcomes depend on many variables outside of our control including competition, algorithm updates, and client participation.
10. Hosting & Maintenance Disclaimer
Unless explicitly stated, we do not provide hosting or ongoing maintenance. Clients are responsible for managing their hosting environment, plugin updates, backups, and related issues. We are not liable for downtime, breaches, or performance issues after delivery.
11. User Accounts
If you receive login credentials for a portal, dashboard, or online platform, you are responsible for protecting your username and password. We are not responsible for unauthorized access caused by failure to safeguard credentials.
12. Testimonials & Portfolio Use
Unless requested in writing, you grant us permission to display your completed project, logo, or testimonial in our portfolio, marketing materials, or social media content.
13. Confidentiality
Both parties agree to keep confidential all non-public business, financial, and personal information shared during the course of the project. This clause remains in effect even after termination of services.
14. Limitation of Liability
To the fullest extent permitted by law, Colorado Web Impressions is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services or website.
15. Indemnification
You agree to indemnify and hold harmless Colorado Web Impressions, its employees, contractors, and affiliates from any claims, liabilities, damages, or expenses arising from your breach of these Terms or misuse of services.
16. Force Majeure
We are not liable for failure to perform services due to events beyond our control, including but not limited to natural disasters, pandemics, internet outages, strikes, or acts of war.
17. Termination
We reserve the right to terminate any service or access at our discretion, especially in cases of abuse, non-payment, or violation of these terms. Any outstanding balance is due immediately upon termination.
18. Governing Law
These Terms are governed by the laws of the State of Colorado. Any disputes arising under these Terms shall be resolved in the appropriate state or federal courts located in El Paso County, Colorado.
19. Updates to Terms
These Terms may be updated at any time. All updates will be posted on this page with a new effective date. Continued use of our services after changes implies acceptance of the revised Terms.
